Hero Nutritionals, LLC announced that on April 23, 2009 it filed a Complaint against Irwin Naturals in the US District Court in Santa Ana, California, Court Case - Civil Action # CV09 -2824 RGK (AJWx), alleging trademark infringement and unfair competition arising from IrwinNatural's' infringement of Hero Nutritionals, LLC registered federal trademark, Yummi Bears®. In its complaint, Hero Nutritionals LLC alleges that Irwin Naturals' "Yummy Veggie Fruities" product infringes Hero Nutritionals LLC's trademarks for its Yummi® line of supplements, including Yummi Bears®, Yummi Bears Organics™ and Yummi Sourz®.
